Before forming an LLC in New York, a unique business name has to be found. See how to find if the LLC name you want is available to register.
Any business or incorporating or forming an LLC in the state can be searched through the Division of Corporations. The Division of the New York Secretary of State regulates the filing for entity formation of commercial enterprises in the state. The database contains records of the following:
- Limited Companies
- Limited Liability Companies
- Limited Partnerships
- Limited Liability Partnerships
Before forming an LLC in New York, it’s important to search the database. Each LLC has to have a unique name and if you skip this step, your LLC paperwork may be rejected.

Step 1. Visit the Department of State’s website to begin the business name search.
Step 2. Enter the LLC name you want to use in the “Entity Name” field. In this example we will search for “Muscle Maids”
In our Muscle Maids example, we can see that another business has registered under that name and nobody else can register it. When doing a search, some results may come up as “Inactive” in the Current Entity Status (circled). For names that aren’t active, there is a chance they are available to register.
Looking at the full result we can obtain information about the entity with details like:
- Legal Name
- Department of State ID Number
- Filing Date
- Entity Type (Corporation, Limited Liability Company)
- Entity Status (Active, Good Standing, , address, etc.
- New York Registered Agent Information
If your search result returns “No business entities were found”, it is likely your name is available to register.
